Terms and Conditions - Our Hall Rules

1. Liability

As a high-risk sport, bouldering requires a high degree of personal responsibility and caution. The extent of personal responsibility is determined by the following rules and instructions. Staying at and using the sports facility is at your own risk and responsibility.

Parents and guardians are responsible for their children or the persons entrusted to their care. Children and young people are at increased risk on the sports fields. Minors must be supervised at all times during their stay! From the age of 14, you may boulder alone (with a signed consent form from a parent or guardian). Playing and running in the recreation and sports facilities is not permitted. Small children in particular are not allowed to stay or be left there. For this reason, children under the age of 3 are not permitted to enter our hall.

In the context of a children's birthday party, I, as the client, confirm that I have written consent from the legal guardians of all children entrusted to my care and that I am authorized to visit FLASHH Boulderspot with the children as part of a children's birthday party. I have informed the legal guardians of the FLASHH Boulderspot's terms and conditions, and the legal guardians have taken note of these.

As part of a school, daycare, club, or social institution outing, I, as the client, confirm that I have written consent from the legal guardians of all children entrusted to my care and that I am authorized to use FLASHH Boulderspot with the children as part of supervised climbing. I have informed the legal guardians of the FLASHH Boulderspot's terms and conditions, and they have taken note of them.

Every customer must show the utmost consideration for other guests. Any behavior that could endanger others is prohibited. If a person is on the climbing wall or climbing, those in the fall zone must keep their distance and leave this area.

All customers must be aware that they may be endangered by falling persons or objects in the sports area and take appropriate precautions. Simultaneous bouldering by several persons on one wall segment or bouldering by several persons above or below each other is prohibited.

Climbing holds can loosen, twist, or break unpredictably at any time, thereby endangering guests and other persons. FLASHH GmbH does not guarantee the stability of the climbing holds. Loose or damaged holds must be reported to staff immediately.

Any collision or accident resulting in injury to a guest or damage to property must be reported to staff immediately and first aid administered in an emergency.

2. Right of use

Only persons with a valid admission ticket are authorized to use the facilities. Use of the facilities is subject to a fee. The prices are listed in the published valid price list.

Children up to the age of 8 (birthday) may only use the bouldering areas marked as "Kinderland" (children's area) under the supervision of a parent or guardian or another adult who is authorized to exercise supervisory responsibility. They are not permitted to enter the other bouldering areas.

Children up to the age of 14 (birthday) may use the bouldering walls in Kinderland and Blocland under the supervision of a parent or guardian or another adult who is authorized to exercise supervisory responsibility.

Young people aged 14 and over may use the facility without being accompanied by their parents or other guardians upon presentation of a written declaration of consent from their legal guardians. Each young person must carry a copy of the original with them on each visit.

In the case of group events, the respective leader of the group event must ensure that the users of the group comply fully with all points of the user regulations. The leader(s) of the group must be of legal age. Minors participating in a group event must submit the relevant form at the ticket office on their first visit to FLASHH and present a copy at the ticket office on future visits.

Any unauthorized use of the bouldering facility will be punished with a processing fee of EUR 200.00. We reserve the right to assert further claims (in particular for damages), immediate expulsion from the hall, or a general ban from the premises, and to report the incident to the police. Bouldering under the influence of alcohol and/or drugs is prohibited.

No liability is accepted for the use of any areas belonging to FLASHH GmbH, including bicycle and car parking spaces, cloakrooms, and lockers.

You are responsible for your own clothing and equipment. No liability is accepted for theft or loss. This also applies to the lockers provided in the hall and the items and valuables stored in them.

The lockers are not intended for the permanent storage of equipment or valuables. All lockers must be emptied at the end of business hours. We reserve the right to open any lockers that are still locked at the end of business hours and to place the items inside them in the lost and found. No replacement will be provided for the opened lock.

FLASHH GmbH shall only be liable for injury to life, limb, and health in the event of gross negligence or intentional breach of duty on the part of the legal representatives or vicarious agents of FLASHH GmbH.

3. Times

The sports facility may only be used during general opening hours. These opening hours are announced on notice boards and on the website www.flashh.de.

The lights in the sports area are dimmed approximately 15 minutes before closing time to signal that closing time is approaching. Use of the sports facilities must then cease.

FLASHH GmbH reserves the right to adjust opening hours for events and on national holidays and those of the federal state of Hamburg. In the event of extraordinary and unforeseeable closures, there shall be no entitlement to reimbursement or compensation.

4. Facilities and cleanliness

No items that are not intended for use in sports may be stored or brought onto the mat areas. This includes, for example, shoes, bags, backpacks, strollers, electronic devices, dishes, or food.

The bouldering walls and mat areas may only be used and accessed with climbing shoes. To prevent injuries, the use of socks, ballet flats, or even bare feet is prohibited.

For hygienic reasons, climbing shoes are not permitted in the sanitary facilities.

Animals are not permitted anywhere on the premises.

The entire facility, including bicycle and car parking spaces and public paths to and from FLASHH, must be kept clean and treated with care.

Smoking and lighting fires of any kind is prohibited throughout the entire facility as well as in the designated bicycle and car parking areas. Smokers may use the smoking area and ashtrays at the entrance to Building 1.

5. Rental equipment

The guest is obliged to treat the rental equipment provided to them with care. The borrower is obliged to replace the list price in the event of loss or damage to the rental equipment. The guest is required to check the rental equipment for obvious defects before use. Defects must be reported immediately.

Rental is only available during official opening hours. Equipment must be returned to the counter at least 15 minutes before closing time. Otherwise, rental fees will be charged for each additional day. Equipment may only be used at FLASHH.

6. House rules

FLASHH GmbH and its authorized representatives have the right to enforce house rules throughout the entire sports facility. Their instructions must be followed.

Guests and visitors who violate the FLASHH GmbH user regulations may be temporarily or permanently excluded from using all FLASHH GmbH sports facilities and those of its business partners.

In the event of a ban from the premises or expulsion from the sports facility, there is no right to a refund of the admission price. The right of FLASHH GmbH to assert further claims remains unaffected.

7. Terms and conditions

Monthly membership fees are collected in advance by direct debit from the member's account. The membership fee must be paid regularly until the end of the contract, even if the member does not use the services.
Short-term illnesses do not release the member from their obligations under this contract. In the event of absence of 60 days or more, the contract may be suspended upon presentation of a medical certificate.
Memberships with a fixed end date (e.g., monthly pass) end on the exact date and do not require written notice of termination. If notice of termination is not given in due time, memberships with a renewal option (e.g., 3-month subscription and annual subscription) are automatically extended by the renewal period specified in the contract.

Termination
The notice period is one month before the end of the term.
Extraordinary, premature termination is possible, in particular in the event of a change of residence to a location outside Hamburg, upon presentation of a registration confirmation with a notice period of four weeks to the contract date. In general, special termination conditions must be requested from FLASHH GmbH. If the contractual relationship ends prematurely, the member undertakes to pay FLASHH retroactive contributions in the amount that would have been payable if the contractual relationship had been concluded from the outset for the shorter term.

8. Data protection

Purposes of data processing by the responsible body and third parties We process your personal data only for the purposes stated in this privacy policy. Your personal data will not be transferred to third parties for purposes other than those stated. We only pass on your personal data to third parties if: you have given your express consent, the processing is necessary for the execution of a contract with you, the processing is necessary for the fulfillment of a legal obligation, the processing is necessary for the protection of legitimate interests and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data. The processing of your personal data is based on our legitimate interest in the aforementioned purposes for data collection. We do not use your data to draw conclusions about your person. The recipients of the data are only the responsible body and, if applicable, the processor. Anonymous information of this kind may be statistically evaluated by us in order to optimize our offer and the technology behind it.

In order to provide paid services, we request additional data, such as payment details, so that we can execute your order. We store this data in our systems until the statutory retention periods have expired.
